1. The Service

RBC TrackSure is a web-based application that enables pharmaceutical companies and regulatory professionals to monitor the status of Pre-Registration and Post-Registration (Variation) applications submitted to the South African Health Products Regulatory Authority (SAHPRA). The Service provides dashboard access, status tracking, Excel report downloads, and automated email notifications.

The Service is not affiliated with, operated by, or endorsed by SAHPRA. All status data is sourced from information provided by RBC Pharmaceuticals Pty Ltd's administrative team and uploaded into the platform. We make no guarantee as to the completeness, accuracy, or timeliness of any regulatory status information displayed.

2. Account Registration

• You must provide accurate and complete information when registering.
• You are responsible for maintaining the security of your login credentials.
• You must notify us immediately if you suspect any unauthorised access to your account.
• Accounts are issued to specific client organisations identified by a unique Client ID. Sharing credentials outside your organisation is prohibited.

3. Service Access

Subscription details and billing conditions, once introduced, will be governed by their respective plan agreements.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorised access to any other client's data or system components.
• Reverse-engineer, decompile, or attempt to extract the source code of the platform.
• Upload malicious files, scripts, or content via the Service.
• Misrepresent your identity or affiliation during registration.
• Resell or sublicense access to the Service to third parties without our written consent.

5. Data and Privacy

We are committed to protecting your personal information in accordance with the South African Protection of Personal Information Act (POPIA) and applicable privacy laws. Please refer to our Privacy Policy for full details on how we collect, use, and protect your data.

You retain ownership of all application data you submit to the platform. We do not sell, rent, or share your data with third parties except as required by law or as described in our Privacy Policy.

6. Intellectual Property

All intellectual property rights in the RBC TrackSure platform — including software code, design, trademarks, and content — are owned by RBC Pharmaceuticals Pty Ltd. Your subscription grants you a limited, non-exclusive, non-transferable licence to access and use the Service for your internal business purposes. No rights are transferred to you except as expressly stated in these Terms.

7. Limitation of Liability

To the fullest extent permitted by applicable law, RBC Pharmaceuticals Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to decisions made on the basis of regulatory status information displayed on the platform.

Our total aggregate liability for any claim arising under these Terms shall not exceed the total fees paid by you to us in the 12 months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may cancel your subscription at any time. Upon termination, your access to the Service will cease at the end of your current billing period. We may retain anonymised usage logs for analytical purposes.

9. Modifications to the Service and Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice on the platform. Continued use of the Service after such changes constitutes your acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of Gauteng, South Africa.
